Terms of service

1. Accepting these Terms

By using the Website or the App, you agree to these Terms. If you use them on behalf of a company or other organization, you confirm that you have the authority to accept these Terms for it, and "you" includes that organization. If you do not agree, do not use the Website or the App.

2. Our website and professional services

The Website presents GLM Digitech and our services (web design and development, e-commerce, digital marketing, hosting, CRM and ERP). Its content is general information only. It is not professional advice and it is not an offer.

Projects and services we perform for clients are governed by a separate written agreement, proposal or statement of work. If such an agreement conflicts with these Terms, the agreement prevails for those services.

3. The GLM Digitech Management application

What the App does

The App is a business tool that connects, with your authorization, to Google Search Console and Google Ads. It reports on the search performance, indexing and sitemaps of websites and provides keyword research. See the App's page for details.

Access and accounts

Only GLM Digitech staff and the clients we invite can use the App. You must keep your login credentials confidential and tell us right away at [email protected] if you think your account has been used without permission. You are responsible for activity under your account.

Connecting Google accounts

When you connect a Google account, you authorize the App to access the data described in our Privacy Policy on your behalf. You confirm that you own that Google account or are authorized to grant this access, including for the Search Console properties and Google Ads accounts it can reach. Your use of Google services remains subject to Google's own terms, including the Google Terms of Service. The App's use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

The App only reads data from Google. It does not change your Search Console properties or Google Ads accounts, and it never spends money in them. You can disconnect a Google account at any time in the App or at myaccount.google.com/connections.

Acceptable use

You agree not to:

• use the App or Website in breach of any law or of the rights of others;
• connect accounts or access data you are not authorized to access;
• try to gain unauthorized access to, probe, disrupt or overload the App, the Website or their infrastructure;
• copy, resell, sublicense or reverse-engineer the App, or use it to build a competing product;
• use data obtained through the App in breach of Google's policies, including for advertising profiling, resale or training AI models.

Availability

We work to keep the App available and accurate, but we may change, suspend or stop features at any time, for example for maintenance or when Google changes its APIs. Reports depend on data provided by Google and may be delayed, sampled or incomplete.

4. Intellectual property

The Website, the App and their content (text, design, graphics, logos, code) belong to GLM Digitech or its licensors and are protected by copyright and other laws. You may view and print Website pages for your own non-commercial use. Any other use requires our written permission.

You keep all rights to your own data, including the Google data you make available through the App. You give us only the rights we need to process it to operate the App for you, as described in our Privacy Policy.

Google, Google Search Console and Google Ads are trademarks of Google LLC. The App is not affiliated with, endorsed by or sponsored by Google.

5. Third-party services and links

The Website and the App may link to or rely on services operated by others, such as Google. We are not responsible for those services, their content or their privacy practices. Your use of them is governed by their own terms.

6. Disclaimer

To the extent permitted by law, the Website and the App are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular search ranking, traffic, keyword performance or business result.

7. Limitation of liability

To the extent permitted by law, GLM Digitech is not liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Website or the App. Our total liability for any claim relating to the Website or the App is limited to the amount you paid us for access to the App in the 12 months before the claim, or CAD $100 if you paid nothing.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for intentional or gross fault, or the rights of consumers under Québec's Consumer Protection Act or other mandatory laws.

8. Indemnity

You agree to indemnify GLM Digitech against claims, losses and costs (including reasonable legal fees) resulting from your breach of these Terms or your unauthorized connection of accounts or data, to the extent permitted by law.

9. Suspension and termination

You may stop using the App at any time and ask us to delete your data, as explained in our Privacy Policy. We may suspend or end your access to the App if you breach these Terms, if required by law or by Google, or if we stop offering the App. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) continue to apply.

10. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. If a change is significant, we will notify App users by email or in the App before it takes effect. Continuing to use the Website or the App after a change takes effect means you accept the updated Terms.

11. Governing law and language

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. Unless mandatory law provides otherwise, the courts of the judicial district of Montréal, Québec, have exclusive jurisdiction.

These Terms are available in French and English. Both versions have the same value. The French version was made available first, and you have chosen to consult the English version.
